Federal Direct Pay (IRA Elective Pay) for Tax-Exempt Organizations

This is the biggest change in nonprofit solar economics in years. Under the federal Inflation Reduction Act, tax-exempt organizations can now monetize the federal solar Investment Tax Credit (ITC, base 30%) as a direct cash payment from the IRS — even though they have no federal tax liability. This provision is called elective pay, or "direct pay."

Previously, organizations like yours couldn't use the ITC at all, or had to use a third-party Power Purchase Agreement (PPA) to indirectly capture its value. Now, a nonprofit, school, or church that owns its system can effectively get about 30% (or more) of the project cost back as cash, dramatically improving payback compared with the old PPA-only path.

AB 2143 Prevailing Wage for Nonprofit & School Systems Over 15 kW

California's AB 2143 generally requires payment of prevailing wage for the construction of renewable systems that take service under net energy metering and are interconnected on or after January 1, 2024. The key exemptions are residential projects and systems 15 kW or smaller. Because most nonprofit, school, and church systems exceed 15 kW, they typically must be built with prevailing-wage labor.
